1. DR. KATE PROGRAMS AND KATE SINER FRANCIS, LLC
If the program includes appointments, you are responsible for scheduling all appointments and attending the calls on time. You will not receive credit from Kate Siner Francis LLC or any of its employees or affiliates for unscheduled or missed appointments. If your circumstances require rescheduling of an appointment, it may be rescheduled any time prior to 24 hours in advance of a session. Kate Siner does not anticipate needing to reschedule, but, if needed, she will provide 48 hours notice and offer additional availability.
If the program includes web calls, Client will be sent an automated reminder of upcoming web calls no less than twenty-four (24) hours prior to the call. Please make sure to add the address of the confirmation email you get from the program so as not to miss any notifications of the calls. If due to a scheduling error or unforeseen event, a call must be cancelled, you will provided additional times either group or individual and every effort will be made to accommodate your schedule.
If your program advertises that you have access between the calls to Kate Siner via email as needed, you agree to allow Kate Siner up to twenty-four (24) hours to respond to emails received during business hours on Monday through Friday 9:00 a.m. to 5:00 p.m. Eastern Standard Time unless otherwise advertised by the program. Emails received outside that time period will be answered within 24 hours of the next business day. Kate Siner asks for your understanding when dealing with particularly long or complicated documents which may require more than 24 hours to formulate a response. She will let you know within 24 hours how long it will take to provide a response.
2. COMPENSATION
Client shall make payment as agreed in the contract regardless of whether the client attends all of the calls or completes the program. Payments are withdrawn every 30 days. Failure to make timely payments may result in loss of program privileges until payments are resumed. No compensation will be given for lost program privileges. See your program contract for additional information.
3. TERMINATION OF AGREEMENT
Kate Siner is committed to providing you with a positive program experience. You agree that Kate Siner may, at her sole discretion, terminate this agreement and limit, suspend, or terminate your participation in the program without refund or forgiveness of monthly payments if you become disruptive. difficult to work with, or if you fail to follow program guidelines.
4. LIMITATION OF LIABILITY
Kate Siner Francis, LLC has made every effort to accurately represent the program and its potential. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. Your success depends on many factors, including your dedication, motivation, desire, background, and work ethic.
You enter into each Dr. Kate program with the understanding that you are responsible for creating your own results and hereby release Kate Siner Francis, LLC from any liability for adverse actions or results experienced by you, the client, as a result of any Dr. Kate programs.
You acknowledge that payment of program fees will not place a significant financial burden on you or your family.
Kate Siner Francis, LLC respects your privacy and will respect confidential and proprietary information, ideas, plans, personal information, and trade secrets. You agree not to infringe on any of Kate Siner Francis, LLC’s copyrights, trademarks, service marks, or other intellectual property rights. Also, you agree not to disclose such information to any other person; that all materials and information provided by Kate Siner Francis, LLC are its confidential and proprietary intellectual property, belonging solely and exclusively to Kate Siner Francis, LLC and may only be used by you as authorized by Kate Siner Francis, LLC. The reproduction, distribution, and sale of these materials by anyone other than Kate Siner Francis, LLC is strictly prohibited.
Kate Siner Francis, LLC is not qualified to provide legal, tax, accounting, or financial advice and the information provided to the client is not intended as such. The client should refer all legal, tax, accounting, and financially related inquiries to appropriately qualified professionals.
While Kate Siner is a licensed mental health provider in the state of Rhode Island, she is not functioning in this capacity in her Kate Siner Francis, LLC and Dr. Kate Programs. Dr. Kate Programs are not intended to substitute for proper regular mental health care as might be needed and contents of the Dr. Kate Programs do not claim to diagnose or treat mental health disorders.
5. PAYMENT SECURITY
When you complete any form on the Dr. Kate or associated website, you can rest assured that your information will not be shared with or sold to anyone outside of the Kate Siner Francis, LLC organization. You will, however, be put on our mailing list. If you do not wish to be on this list, click the unsubscribe option at the bottom of the newsletter.
a. All payments taken from the site are processed in the Infusionsoft platform. The credit card information we take through an Infusionsoft order form, through the shopping cart, or enter manually as part of recording an order payment is automatically encrypted. This protects you from credit card fraud.
b. Infusionsoft is a Level 1 e-Commerce Application Service Provider. They provide their customers with a method of collecting credit card data through a shopping cart, order form, or manual order which they then pass to a payment processor. As a Level 1 Service Provider, Infusionsoft must comply with a rigorous set of standards set forth by the Payment Card Industry Data Security Standard (PCI DSS).
